Waitangi Tribunal Findings Back Tāngata Whaikaha Māori Calls for System Reform

Aotearoa New Zealand’s disability-rights sector is calling for a fundamental shift in authority following the release of a landmark Waitangi Tribunal report on Monday, 7 September 2026. The report, titled Hauwhaikaha: The Disability System Report, was issued as part of the Wai 2575 Health Services and Outcomes Kaupapa Inquiry, which conducted hearings between 2022 and 2024. Dr Huhana Hickey (Ngāti Tāhinga, Waikato, and Whakatōhea Ngāti Ira), a prominent academic and disability-rights lawyer, told Waatea News that the findings confirm decades of advocacy by whānau hauā. The Tribunal found that the Crown has breached Te Tiriti principles by failing to adequately partner with tāngata whaikaha Māori or support kaupapa Māori providers. The report highlights that Māori experience significantly higher levels of disability and inequitable access to health and disability support. Dr Hickey, who lives with multiple sclerosis and serves on the Human Rights Review Tribunal, noted that the current system is fragmented and difficult for whānau to navigate, particularly for those in rural areas. The Tribunal’s conclusions emphasise that the Crown has historically failed to recognise the tino rangatiratanga and mana motuhake of tāngata whaikaha Māori, often developing policies without genuine partnership. One of the most significant aspects of the report is the recognition of kaupapa Māori providers as vital expressions of tino rangatiratanga. However, the Tribunal noted these providers are not receiving sufficient funding to meet the needs of their communities. Dr Hickey argues that for real change to occur, disabled Māori must be genuine participants in decision-making processes rather than just consultees. The findings suggest that sustainable hauora Māori depends on the system's ability to resource Māori-led responses and address the systemic barriers in housing, transport, and employment.
