Minister Tama Potaka releases details on Waitangi Tribunal appointment process to ensure diversity

The Minister for Māori Development, Hon Tama Potaka, has released official advice detailing the appointment process for the Waitangi Tribunal, emphasizing the need for a broad range of expertise to uphold the partnership between the Crown and Māori. The proactive release, published on Tuesday, 22 September 2026, outlines how the Government identifies and selects members to serve on the statutory body. Established under the Treaty of Waitangi Act 1975, the Tribunal consists of a Chairperson and up to 20 members. According to the released documentation, the Minister must consider a candidate’s personal attributes alongside their specific knowledge and experience in matters likely to come before the Tribunal. This includes a strong focus on the partnership between the two parties to the Treaty. The documents identify five key areas of expertise essential for the most recent round of appointments: Mātauranga Māori, Law, History, Crown policy, and General leadership. Specifically, the Tribunal seeks members with deep knowledge of tikanga, kawa, and Te Reo Māori, as well as those with experience in community leadership through iwi and hapū service. The legal requirements are also stringent, requiring those in presiding roles to have held a practicing certificate for at least seven years. Te Puni Kōkiri manages the process by providing the Minister with a list of suitable candidates once directed. While positions are not publicly advertised, the Minister frequently consults with the Tribunal’s Chairperson and the Minister of Justice to ensure a diverse range of perspectives. All successful recommendations must undergo the Cabinet process for confirmation before being appointed by the Governor-General for terms of up to three years.
